I have come across one interesting procedure in the USCIS website regarding beneficiaries of LPRs and I am asking a friend in the US in an immigration law firm to verify about this. I am just waiting for her to provide me the details and I will inform you about it since you can also be filed as derivative beneficiaries of your wife as an alternative way for you and your daughter to be with your wife.I do pray and hope she gives me a positive response.

I don't see what is really different. I am not talking about July 2007. I am talking about May or June bulletin 2007. Do you mean the bulletin on May or June 2007 is to utilize the visa so the dates are not the "real" date? Then how do you know Aug. 2008 move is not for the same purpose? Especially if this movement is caused by spillover.
There is chance that CIS and/or DOS know the breakdown of categories by country now as against last year. That is being a bit on the optimistic side.

I am happy to send out this letter. Have done this before but I wanted to know if IV core supports our efforts in sending this letter. Please pardon me, I am not trying to qs the validity of this letter or anything else with this but I haven't heard or read anything from IV core regarding the EB-3 I plight and their course of action (again excuse me if I have misjudged). I would like to hear from IV core on this. Thanks again.

He was going by the logic that apparently DOS was releasing visa numbers on a quarterly basis. It should be clear now that it is not true. DOS is no longer releasing visa numbers on a quarterly basis.

I do believe that each person has the right to champion for whatever cause s/he believes in. But don't you think that instead of this class war we should fight the USCIS system and ensure FIFO. I believe if we have a transparent and smooth USCIS functioning then a lot of our problems will be solved. At least we will know where we stand without the uncertainty!!

``(C) those immigrant workers who had petitions approved based on Schedule A under section 656.5 of title 20, Code of Federal Regulations, as promulgated by the Secretary of Labor.'';
I guess that's us, got that from Thomas Library. The bill is being considered in the Senate.
Durbin also got one "favorable" amm. for us - another $1500 for each recaptured visa number. I believe after all expenses, and all time spended on the immigration and exams, majority of us could deal with that extra cost, or "bonus" if you like::))) So I hope that Durbin's amm. will calm down anti-immigrant forses and Cornin'n one will pass!

You have to consider the scenario where both spouses have LC pending in PERM and BEC- and only one may have applied for 485. I'm just hoping people who have bought the LCs and tuned their work experience to suit available LC would be scrutinized strictly and would stay in I-140 stage longer.
Out of the 144k perm, FEW have 2 labors (1 in eb3 and another in eb2). Also many have labors in BEC as well as PERM (THIS IS QUITE A LOT). So the total real applicants combined from BEC and PERM could be around 200k. Not all the dependants (kids) need EAD. Not all the primary applicants apply for EAD. The total approximate EAD applicants could be 350K.
ALSO, ONE THING YOU HAVEN'T CONSIDERED...As the priority dates are unavailable until october and the expected slow movement of the 2008 bullettins(because they have the count of pending applicants now), there will be only very few EAD applicants in next few months. How ever, all these applicants will re-apply every year...they they can expect this same load until they provide a relief to issue visas to everybody.
Note: Next year..expect the same delay for renewal.

I am also working on a FHA (4.875%) with GMAC with 3.5% down.
Wife's H4 was an issue, but that got cleared
Now the last thing is they are asking for 3 yr Continous VISA from the date of closing.

For all those who have sent PM.... Please note I am not an attorney or accountant... But then I had consulted my account and few attorney's ( paid the required fees to get them answered)... So please use your own judgement/caution.
1. Yes you can open a LLC singly or jointly with your wife/friend/anyone.
2. You can start the LLC even when you are on H1B but it is better that you wait till you get your EAD to get oprationalized. reason very very conservative view is that you cannot even write a check for your company or deposit a check... but this is a very conservative view....
3. To open a LLC you can use an accountant ( if you have one, it will be cheaper by a couple of hundred dollars) or use agencies like www.legalzoom.com/legalzip/LLCs/llc_procedure.html .... I have used both in the past....
4. Intially you can just form LLC as single or joint partnership and then elect as S corporations for taxing.... I forget within which period it is to be done, if I correctly remember when you file your first tax return or within 6 months you need to elect as filing as single person entity( then it becomes like your personal income) or you could elect as S corp....
5. You will a tax id for the LLC, business license and other documents when you form a LLC, You will need to maintain book and tax records for 3 years... best to have it managed by an accountant
6. You/ your spouse can work for your LLC.... Some of you if you want to after 180 days change employers can move into your LLC and maintain that you are employed in same occupational duties for your own LLC...
