Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

Correct me I am wrong here:
AP allows you to enter US without a valid visa.
EAD allows you to work in US for any employer.
Untill and unless someone utlizes his EAD, he is still on H1 (if he has valid H1) doesn't matter he enters US using AP. Am I correct?
Then question arrises, If H1 holder changes his job then he needs to transfer his H1 only and not use EAD. Is this possible to have H1 renewed and transfered even though one has EAD approved, meaning is it compulsory to use EAD one you get it?

as per my knowledge"One should file a new LCA for an H1B petition" if work location changed from one state of US to other state.

My uncle just received his L1 extension receipt. Lawyer was late in filing the L1 extension, but supposedly got everything ready and mailed it 2 days before the L1 expiration date.
However, my uncle received recepit for L1 extension, and received date is 2 weeks after the expiration of original L1. Please note I am talking about RECEIVED DATE (not Notice date or receipt date).
Does this mean extension will automatically get rejected based on late filing? Is there any recourse to this?
More importantly, Is my uncle Out of Status now? (He doesn't have anything else going besides L1)
Please let me know as soon as possible.

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

Short term disability usually is not considered a Public Charge. This is because they are usually carried by private insurance or state agencies and not federal ones. However, I would check if one can claim SDI under CA law if one is not a Permanent Resident or a U.S. Citizen.

My i140 was approved 2 months back and now i got a Full time position in another company.
So my question is, after moving to new company if the dates are made current can i still file for i485 with my old employer if he agrees for it?

Just need some suggestion:
I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)
My 140 is pending...
so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?
i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?

I have a question regarding the I765 form. In the I 765 form it says Have you ever before applied for EAD to USCIS. I did my MS from US University and got OPT also known as EAD and worked on it for an year. Now my question is do i check yes or no? Do i consider that as EAD or just OPT.
