Hi Frens,

can someone help me.

I am applying for H1 visa to the US. I got my passport in my graduation. So i donot have the ECNR clearance. So please can someone tell me if I will have a problem before applying or should I get it done now and then apply. I however have the Canadian visa stamped on the passport.

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.

I want to use AP again, is there any problem.

Has anybody done that.

Hello All,

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.

IV can help in this matter.

If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

i was in same situation. my wife's AP was approved and mine not, before leaving US, so i went for h1 stamping but, my wife didnt. on return, i entered on H1 and she entered on AP.

SFO port. they asked her to go to secondary inspection room, had to wait for 1/2 hr. they called her name, no questions asked, gave her docs back. we both were in.

this was back in Feb'09. i work directly for F100, popular company.

Hello IV.org - I am on H1visa, which is valid until Sep 30th 2010 with stamping. To get eligible for a new 6year H1visa - Can I work for the same company but geographically located out side of USA for one complete year. [ Let's assume from Oct 1st 2010 to Sep 30th 2011]

Then apply for the new H1 from the same company in april 2012? OR can I apply in april 2011 and enter US at Oct 2011?

I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -

1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?

Please Help...

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.

Hi Experts,

Would appreciate your help here. My sister is studying on H4 visa and her husband applied for I-140 in EB1 but it got rejected and now they have filed appeal for the same. He has his I-140 approved for NIW already though. Currently, My sister wants to move from H4 to F1 Visa as NIW case will take a lot of time and EB1 case has less chance of getting approved. Is there any problem in doing so ? Will having approved I-140 for NIW or pending appeal case affect her F1 application ?

Hi All,
USCIS has mailed my wife two different EADs upon renewal. The first EAD sent to us has a 2yr validity. About a couple of weeks later, she got another one, this time with a 1yr validity.

I spoke with my attorneys and they seem to indicate that the one with the 2yr validity should be the valid document of reference from here on.

My questions are,
1) have any of you experienced this kind of a goof up before?
2) do I just take my lawyer's word for it and ignore one of them?

Please advise...

As far as I know it does not matter what company profile is, it only matters what type of job they have and if they able to pay as required for the period of time they apply for.

Are you still back in your own country? Working? Or did you just get your bachelor's in the US and are still in the US,
