We all know that these IT companies/ "body shops" will not bear the brunt of this.
It is always the employees who will get distressed. Large organizations will quietly offshore more jobs while smaller ones will charge this from the employee, legal or not.
I pity those who think this will create more jobs for Americans. They are truly ignorant of how the system works.
And like most of you already mentioned, it's funny how a small group (few thousand) of legal immigrants are targeted while millions of illegals (and the companies that hire them) are going untouched !

I agree 100% too. Just feel so helpless.
After reading all your comments, I reached to a conclusion

Now the question is, what are we going to do about it, keep complaining and whinning about it, or do something constructive.

Ramba - you seem to be working through a body-shopper as a plain consultant with restricted veritical movement in the organizational chain which implies your underlying assuption that if same org files multiple petitions for the same person.
In 2003, they were not able to skilled developer so file my eb3...now after one completes master's degree ..experience in other companies if they find that the cannot find experienced manager and after due recrutiment process find that one of their own employee is the best fit for that job.
So now u are saying that they should not do it? That will be a company discriminating against their own employees???

Great find, Andy. Based on your explanation, I can say that our real problem is not the lack of visa numbers. There are enough visa numbers, but USCIS is not utilizing them.
This also tells me that an increase in visa numbers to 290,000 (or what ever number that the SKILL bill is asking for) would NOT change the situation a little bit. The end result only will be that the USCIS will end up with more number of unused visas.
Can the IV community do some thing to improve the whole situation?

You applied for your Labor and waited(establish a PD), everybody who applied after you was behind you.
After the Labor was approved, you applied for the I-140. This will determine your category/country of chargeability and will filter some of the fraud cases
After the I-140 was granted. You apply for either CP or AOS. At this point CIS/DOS knew how many applications were pending for each category/country and could move the dates smoothly.
Now the mess is so big that it takes them until February(6 months after the End of the previous Fiscal Year) to publish the number of visas issued

You must be a permanent resident to open or own an S-Corp. An LLC is the best way to go and if you are not engaged in actual sale of goods, you can register this LLC in Nevada and pay no corporate taxes. I've done it. All income then passes through your own filing. Have a CPA and I strongly recommend you do this. Registering a NV LLC only costs $195 annually. Go to incorpservices.com and it will walk you through.

We're much better off here in the US when you compare our compatriots suffering in Britain. Britain has enforced a lot more regulations on immigrants, much to their chagrin.

That's exactly the point..USCIS is HEADED by fools...the problem lies within...the heads dont really care if their staff is underpaid and over-worked..but the fact of it is that they just don't have the money nor manpower to get the work done. When USCIS adjudicated all those cases in 2002, it was not of their own volition but because Congress mandated it..6 years later they dont care for the immigrants..u think they'd (policy makers) care 2 hoots for the the USCIS officers...just take a look at the Infopass centers...from my experience I havent seen more than 2 officers helping customers at a time..no money..no manpower

Guys/Gals - Those of you who are planning to file your 140 and/or 485 and are worried about the future consequences, please stop worrying about the bill and first of all get your 140 and/or 485 filed.
Now, when you are done with it , please help IV to ensure that the current bill has enough amendments to make our future secure.
If you are one of those who can keep working on your 140/485 , worry about the bill and help IV all together in a balanced way, no need to follow the step by step process :-)
Things happen - they can always happen - they can be good - they can be bad - but Life Goes On.... so you do what you need to do for your current processing and whatever plans you have for future but just be aware that things can always change. Say you dont file your 140 assuming the world's gonna end and then before the world ends, 140 premium processing is stopped - ( not that there are any rumours regarding this ).... so get the point - carry on with your processes assuming the best out of this bill and help IV as much as you can.

The date of the I-140 approval matters just in case the visa dates are retrogressed again before your case is adjudicated, in which case it will be better the longer the delay on your 140 approval. See examlpe 5 in raju123's posting above.

Yes I believe paperwork will be filed for all my dependants concurrently. Does it even matter when the I140 is approved?
It seems that under the new law his cutoff date is Jun 1 since that is when my priority date will be current so as long as he applies for a green card within one year he is ok.
So if we apply concurrently when is his green card application deemed to have been applied for? When we file concurrently or only when and if the 140is approved.

Beginning early in 2007, there has been a noticeable slowing in case processing at the U.S. Department of Labor (DOL) Atlanta Processing Center. This center is one of two locations where PERM labor certifications are adjudicated. The other location is in Chicago. This slow-down is a marked change from the generally fast PERM labor certification decisions that had become the norm.

I am in the same scenario as you since my firm is headquarted in NY . Can you check with your attorney about the processiing times they are seeing for labors filed with the Atlanta processing center . My law firm says that the processing times are more or less the same for Atlanta and Chicago .

Jumbo loans are not getting approved for EAD status. Banks are rejecting Jumbo loans (> 417K) if your immigration status is EAD or AOS. I don't have any idea about normal loans (< 417K). But banks are giving Jumbo loans if the status is H-1B.

SriKondoji & I both being from the NE area we communicated through this thread possibility of car polling for DC and I received a call from him last thursday(Aug 9th) regarding this from some Ohio area code. So buddyinus I can at least assure you he was travelling at that time.
Receiving a call from Ohio Area Code dozn't mean that hez in Ohio. Wake up. Anyway, my point is...We've seen a lot of this guy...Dont trust him. He mislead ppl on the other thread and ppl started booing him. But he was goin on and on and on...I just realised he was the one to start this thread too...Its already 6 days since Monday and this thread is still alive. Doz he even have any decency to acknowledge his mistakes. Admins...When somebody reads something like "June end and July 2nd filers receipts by monday" on ur homepage they get excited. Bottom line is, its misleading. The "Monday" is already gone and nobody knows when USCIS will process July 2nd receipts. Pls delete this thread. SriKondoji is notorious for spreading false rumours.

As much as I appreciate the efforts that the IV core team has put in, them being so secretive, it is almost like they have formed a cabal.
I agree with ItIsNotFunny. The very least the IV core team can do is post updates on what they are up to. That way if someone believes in a particular initiative that IV is undertaking wants to help, they can contact the concerned IV core team member and offer to help.
I am sure instead of the core team trying to burden themselves with all the work, if they let individuals who believe in particular cause to help them, then life would be a lot easier for everyone. I guess that would also get more people involved with IV.
I know I am out of the rat race, so if you think I am being patronizing, my apologies.
