LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

Hello All,



I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .



My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

U can ask your HR (if they are willing) to create an account for u on the PERM website...u can then login and check the status.

Hello There,

I just got an RFE on my 485 as following.

Submit a letter of employment attesting to your current employment. This letter should be written on the company's official letterhead and cite the date you started working, whether the position is permanent and full-time, a description of the position, a description of the position that you currently hold for the company (if any), and the offered salary.


When I invoked my AC21, my new lawyer submitted G-28 but with out any details about my new employment. I hoping that this RFE is related to that. My only concern is that my old job title is programmer analyst and my new job title is Business Solutions Architect with similar (probably a little more) job duties.

Please share your experiences if any one has received similar RFEs.

I filed I-131 for AP renewal around 10th August and received a Biometrics appointment notice for I-485 yesterday. Is there Fingerprinting required for AP? If yes, why is the Case Type on the notice I-485? Or is the FP notice for I-485 and it is just a coincidence that I have filed for AP renewal. My PD will be current next month...

There is no LUD on I-485 case...
