Guys, applied recently for EAD and its pending and 180 days has not passed. I am planning to open a part time business. Does anyone know if its ok to start a part time business before the EAD gets approved ? Any insights will be appreciated.
Thanks

If you draw salary as an employee of the business, it is a problem. Consult an immigration attorney. You cannot take up any work other than what is approved as part of your H1-B.

Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.

It is safe to apply for N-400 after 90 days prior to 5 years and your wife can wait and apply in another couple of months.

Yes, it can be transferred. Fees will include a fee for I-129 ($320) and a fraud prevention fee, which is $500. The employer fee is waived if the non-for-profit company qualifies as non-profit under the U.S. immigration laws.

Can one obtain a photo ID on a visitor visa? This way the visitor need not go everywhere with his / her passport. Please advise.
If you can manage to get the points required to get a State Photo ID then you can get it. It will be valid for the period of the visitor visa.

Hello
We moved to a new location after filing our 485, EAD and AP petitions. We immediately sent the AR11 forms (by Fedex) and also did the AR 11 form online. Apart from this we updated the addresses for all pending petitions.
The status is as follows:
1. My wife's EAD went to the old address and fortunately USPS forwarded to our new address. However my EAD has not yet reached me though when I check online it looks like it was approved on 1st Oct. How do we track this?
2. I have received the address change confirmations from USCIS for my 485 petition. I have not received the same for my wife and daughter's petitions. Do I have to go and update the address change once again online?
Kindly advice based on your experience.

When a particular priority date becomes current in the next month's bulletin, say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.
Any response is appreciated.

Opponents of health care reform efforts have accused the President and Democrats in Congress of including millions of illegally present immigrants in proposals to expand health insurance coverage. Whether one thinks that including such individuals is good or bad, the fact is that only lawfully present immigrants will be eligible for inclusion in the various proposals being considered in Congress. Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants.

I'm in Spain this week so can't give the full treatment, but thanks to readers who sent this happy news. The US has won the Nobel Prize in medicine for work done by these two scientists as well as Carol Greider. Blackburn is Australian-born and Szostak is British-born. They received their award for genetic research that is described here.

Nikon's very competitive price point on the 10.2 MP D200 (http://www.dphoto.us/news/node/2003) ($1,849) will definitely test Canon's bet on the full frame and much more expensive 5D. Read about the new D200 here (http://www.dphoto.us/news/node/2003). It should also hasten an announcement to a succesor to the 20D.

Hello All,
I am stuck in a very painful scenario right now. I am working on F1-OPT which ends on Feb 5th 2011 and have a pending H1-B application under premium processing. The thing is my employer says that they will terminate me on Feb 4th and cannot guarantee a rehiring even if H1-B is approved.
My employer needs to know if there is something (legal) like temporary termination and rehiring ? If yes then what does the employer need to do to rehire. And is there any documentation about this. My employer wants to check this documentation before reconsidering.
Any inputs would be appreciated.
Thanks
sak.

What is your question?
If your question is "Do you have to write your name in your native script in Form G-325 in addition to writing it in Roman alphabet?" -
Yes, you do.

continuedProgress: AFAIK & IMHO - Only people in valid H/L status can travel outside USA while AP is pending. Your wife is on F1, if she travels outside USA with out the approved AP on hand, her 485 is considered abandoned. You can have second opinion with your attorney.

This is a detail from the June USCIS Ombudsman report I hadn't noticed before, but a BusinessWeek report this week highlights that fact. We immigration lawyers have sensed that this was the case, of course. We regularly warn clients now to simply expect them even if the case is air tight. Businessweek reports The U.S. Citizenship & Immigration Service says no crackdown is afoot. 'We haven't changed the way that we do our business over the course of the past few years,' says agency spokesman Christopher Bentley. Of course, the statistics show otherwise. One very senior former USCIS confided in...
