I am applying for H4 visa after my recent marriage with an H1B visa holder in USA. I am currently filling out the online DS160 form but stuck at the following stage: "travel information"
In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

Hello, I am following along on the advanced tutorial for data binding with XML, and I am using Blend 3, I know the tutorial uses Blend 2. I was hoping you could help me find the "define data templates" equivalent option that is not present in Blend 3, for the step that modifies what elements from the xml data source are displayed in the listbox.

Enrique's Journey (http://www.npr.org/templates/story/story.php?storyId=5225180) is a very powerful book written by an LA Times journalist about illegal migrants who take the Tren de los muertos, or the Train of the Dead to get to the US.
Will it be the kind of book, like 'Uncle Tom's Cabin' (http://en.wikipedia.org/wiki/Uncle_Tom's_Cabin) to shake the conscience of a country to generate true Immigration reform? Will it move the likes of even politicians, who have no conscience, and get Immigration Reform accomplished?
I hope so. I had tears all through while reading the excerpts from the book, and hearing Sonia Nazario on NPR today.

The AP document should say that you can be paroled until ABC date. That is the expiration of the AP.

I understand the wages lesser than specified in Labor is a real potential issue. But what about wages much higher than specified? 10-20% increase will be fine, but what about 50% or 100% jump.
Many of us live in consulting world and in a billing sharing mechanism where your annual wages fluctuates. I am talking to a potential client which can give me a significant raise (please note I am not transferring H1 or using EAD and will be staying with the same GC filing company with 140 approved and 485 pending).
Has anyone ever met a real case when high wage jump created a problem?

I was in a similar situation and my lawyer advised to apply for H1 (come April) even without the H4 extension. A query will be sent asking to prove your status until atleast Sep 30th. You can then attach your H4 papers (assuming your H4 extn is approved by then).
Anyway, i am planning to apply for extension using premium processing just to make sure things progress smoothly.

Currently I am working for employer A on H1B. I have applied for I-485 and have EAD. I have one permanent opprtunity from a consulting firms B. Compnay B is asking me to join on EAD. But threir current client is in Canada. So compnay B want me to travel to Canada, every week, retun back to US in week end. Can I do this while working on EAD. I am just worried wether it will cause any problem. They told that that is the reason they do not want to do H1B.

This is based on the concept that the corporation is a separate legal entity fron its owner. However, self-sponsored H-1Bs are subject to careful review. I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.
I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.
Please advice. What should I do.

Can i travel on my H1B and Advance parole (EAD) and maintain the same H1B when i come back to the US? I've heard rumors that I will be forced to use the EAD on arriving at the airport. Hence I will lose my H1B (They have been serving as backups to each other)
Here are some additional details:
- Currently working for a company as an employee on my H1B
- H1b doesn't have valid stamping (should i go that route and get that??)
- My 485 Pending. Priority date is Aug 2005 on EB3
- Indian Citizen but born in Africa (EB3 is Rest of the World)
- Have had my EAD for the past two years (havent used it).
- i switched over companies last year and ported the greencard process - AC21
- I have an expired Advance Parole i filed over an 1 1/2 years ago (never used it) and was planning on re-applying for it
- I've lived in the US for the past 15 years and have at no point been illegal.
- Planning to travel to Europe in June.

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?:confused:

My parents are planning to apply for visitor visa. My aunt (dad's sister) has applied a immigrant petition for him about 4 years back and it is still in process. If my dad applies for a visitor visa which is non-immigrant intent, will he face any issues with issuance of visitor visa ?

Canadian-born Justin Bieber is today's selection in honor of my teenage daughter who went with her girlfriends to hear the 16 year old singer here in Memphis over the weekend. Bieber has the distinction of being the first artist to have seven songs from a debut album listed on the Billboard Hot 100 at the same time and his second album debuted at #1 on the charts.
