My story:
In my 2 work exp.letters submitted to CIS, I break down the number of months I was working with company A with 2 different positions and stated my duties & responsibilities. I started as an electrical technician from 06/'07 - 01/'98 (7mos.) and move to Sales Engineer position from 02/'98 - 09/'98 (7mos.) so that a total of 14 mos. CIS only counted the electrical technician experience since my labor application position is electrical technician. However, the position of sales engineer, also entails the work of an electrical technician. meaning sales works is an added duties for the technicain job.
Moreover, my second letter, company B with a job title of Technical Trainee was totally disregarded. Where in fact, my work is actualy training a would be
"electrical technician". Now I just need to find ways to justify that to CIS. I dont know how to start though...could anybody help me here????

Bill HR 4853 Passed the house. It has already cleared the Senate.
Expect most people to see an increase of $100-200/month in their pay check!
D-Pomeroy's amendment for estate tax failed earlier.

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

Hi,
I am currently in Dallas. For applying a duplicate passport, it is OK if i Mail my application through USPS express mail which provides acknowledment . Can anybody please tell me if there is any problem with this?

If your question is whether you will be considered to continue in valid H-1 status after returning to the US using your AP, then the answer is yes.

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

I know this issue is still a grey area and certainly no one seems to know a concrete answer to this.
If i have my H-1 Visa and EAD as well. Can i continue to Work on my H1-visa for the primary employer and take up a part-time job with the EAD.
I have hear ppl say that H1 becomes void once EAD is used. Is there any kind of document advocating this? I have not seen any. Lawyers have conflicting opinoin. Has anyone thought about this. I have decided to take an infopass appointment and ask the IO to show me a document that states that H1-becomes void or The other way around.
Can anyone shed more light in to this. Thanks

Hello Everyone,
If primary applicant of I-485 uses AC21 and Spouse of primary applicant not planning to work for at least 3 years because of infant kids. Could we please share what are advantages and disadvantages you can think of for not applying an EAD for secondary applicant until ready to find a job?
Following are list I can think of.
Disadvantages
- Secondary will not get SSN and tax rebate
- Would have to renew for 3 years even though not going to use
Advantages
-If get lucky get a Green card without using EAD ever
I have heard issues with Driving license but that's with having EAD.

I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.
