A new report from the Economic Policy Institute makes the case that immigrants at all wage levels actually lift wages for US workers:A key result from this work is that the estimated effect of immigration from 1994 to 2007 was to raise the wages of U.S.-born workers, relative to foreign-born workers, by 0.4% (or $3.68 per week), and to lower the wages of foreign-born workers, relative to U.S.-born workers, by 4.6% (or $33.11 per week). Hi,
I am working for a company who filed for my GC.
I-140 approved 18 months back
I-485 "applied and pending" 12 months back
EAD in hand from about 10 months.
If I move to a company with the exact same job description,
a) Whom do I need to inform, with regards to , AC21 portability clause
b) Who will check if the job is in the exact (same/similar) field
c)Possibility that there will be RFE after I-485?
d)What if the GC sponsoring company is not helpful after I move to a different company. How is this going to affect?
I need to weigh in the costs associated with countering a RFE and the increased salary due to job change.
Let me know your opinion.

My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.

I Just learnt that the Name Check for my I-485 was processed under a different Alien number when it should be processed by alien number assigned in I-485 case. Since it was cleared under a different number (probably the one for I-140), I-485 file did not have this information and now they are getting it fixed. So when everything in my case is current, this came up right at the time when they will almost be getting out of visa #s. :(
I recommend you should all contact your service centers where your I-485 was filed and make sure that yoru name check is in process or got processed under correct alien number. If the service center refuse to provide any information, contact your congressman office and have them verify this information. You can find who is your local congressman by going to http://www.visi.com/juan/congress/.

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?
